Terms and conditions
BASIC PROVISIONS
These Terms and Conditions govern the relations that arise between the Seller, who is Pavol Zlatovský (also "the Operator"), and the Buyer on the basis of an order made by the Buyer through the zlatovsky.eu website.
The information or personal data provided by the Buyer shall be processed in accordance with these Terms and Conditions. By using the zlatovsky.eu website, the Buyer agrees to the processing of the information and data they have provided, and also agrees that all the information and data provided are true, complete and correspond to the facts. The Buyer bears the full responsibility for providing true, complete and factual personal data in accordance with the relevant legislation. When placing an order on zlatovsky.eu, the Buyer confirms that they are legally competent to do so.
ENTERING INTO THE PURCHASE AGREEMENT
The Parties enter into the Purchase Agreement when the Buyer puts the selected goods in the basket and sends the order, while being responsible for the correctly filled in data. By creating an order, the Buyer agrees to these Terms and Conditions of sale without any reservations. Once an order has been placed, the Seller shall send a notification of receipt of the order and the invoice to the email address the Buyer has provided in the order.
PAYMENT
The payment for a work shall be made by bank transfer to the account specified in the Checkout section when placing the order or in the invoice, within 7 working days of the invoice being sent to the Buyer to their email address specified in the order. The invoice number shall be used as the variable symbol. It is advisable to include the name of a work in the payment note.
CUSTOMIZED PAINTING
In the event of ordering a customized painting, the communication shall be in the electronic form, containing the details of the ordered painting. After a mutual agreement and setting of the price for the customized painting, the Buyer agrees to pay a deposit of at least 50% of the total set price of the work, whereby the Purchase Agreement is established, too. The Seller shall only start the work after the deposit has been credited to the account. Should the Buyer withdraw from the order, the Seller shall not be obliged to return the deposit if he has started the painting. The digital design of the work, the sketch of the work on a separate medium or final canvas shall be considered the starting point of the painting.. The Buyer shall be informed of the start of the painting without delay and be sent the invoice with the total amount when the painting has been completed, and the Buyer shall only pay the amount less the deposit amount. Once the full amount has been credited to the Seller's account, the Seller shall hand over the painting to the Buyer as agreed.
SHIPPING
Shipping within Slovakia is carried out by various companies at the discretion of the Seller who considers various factors such as efficiency, reliability, affordability, and suitability when it comes to the dimensions of the goods. The Seller shall dispatch a work without delay, but not later than 7 working days from the date of crediting the invoice amount to the Seller's account.
COPYRIGHTS
An artwork is created as a single original. The authenticity of a work is proven by the author's signature on the front of the painting. The provisions of Act No. 185/2015 Coll., the Copyright Act, as amended, as well as the international agreements on the protection of authors' rights apply to the works. The author's exclusive right to make a recording of a work of art and to publish it for commercial purposes shall be retained even after the Buyer has purchased the work.
ACCEPTANCE OF A WORK AND THE COMPLAINTS PROCEDURE
The Buyer is obliged to inspect a delivered artwork upon its receipt from the carrier. In the event of a mechanical damage to the artwork or the packaging of the shipment (torn, soaked or other damage to the packaging), the Buyer is obliged to create a record of the damage with the carrier, which shall be signed together with a representative of the carrier. The carrier shall be responsible for any damage during the shipment of a work to the Buyer. On the basis of the record created and after non-acceptance of the shipment, the amount of the invoice shall be refunded to the Buyer within 7 working days at the latest.
In the event of any problem with the transport company, the Buyer shall contact the Seller without delay and provide the description of the problem, contact details, invoice number and the name of the work.
Upon discovery of any defects other than those caused by the carrier, the Buyer shall immediately inform the Seller by telephone or in writing by e-mail, stating the problem encountered, contact details and invoice number. The Seller shall not be liable for any damage caused by improper use of an artwork (e.g. exposure to weather conditions, high humidity, etc.), by external events and improper handling (a fall from the wall, improper handling during carrying, reconstruction, improper storage, cleaning, etc.). The Seller is obliged to inform the Buyer about the method of dealing with an issue not later than 3 working days after being informed as per the previous sentence.
WITHDRAWAL OF THE BUYER FROM THE AGREEMENT
The Buyer is entitled to withdraw from the Agreement within 14 working days from the date of acceptance of the work without stating a reason. The withdrawal of the Buyer from the Agreement terminates the Purchase Agreement, and the Buyer is obliged to return the artwork to the Seller, unused and with the proof of purchase from the Seller (invoice). The artwork must be sent by registered mail or courier to the following address
The Seller shall not be liable for any loss or damage during transport. The cost of returning the goods shall be borne by the Buyer.
In the event of withdrawal from the Purchase Agreement, the Seller is obliged to accept the work and refund the Buyer the amount paid for the work according to the invoice no later than 7 working days from the date of acceptance of the returned work by the Seller, if the work is delivered back to the Seller in the original condition as it was sent to the Buyer.
When ordering goods made according to the Buyer's special requirements (customized painting), it is not possible for the Buyer to withdraw from the Agreement.
In the event of damage to an artwork due to improper handling or insufficient packaging when the artwork is being returned upon the withdrawal by the Buyer, the Seller shall be entitled to financial compensation for the damage incurred, which shall be claimed from the Buyer from the amount paid according to the invoice for the artwork. The Seller shall be entitled to compensation up to the full amount for the damage to the artwork.
WITHDRAWAL OF THE SELLER FROM THE AGREEMENT
The Seller has the right to cancel an order if the invoice amount has not been paid by the Buyer within 7 working days of sending the invoice to the Buyer. The Seller also reserves the right to cancel or process an order late in case of force majeure, unexpected events or other reasons making it impossible to process the order, of which they shall inform the Buyer.
FINAL PROVISIONS
If the Seller cannot deliver an ordered artwork, they are obliged to inform the Buyer thereabout and refund the paid price for the artwork as per the invoice within 7 working days or to offer them a suitable alternative under a mutual agreement. The Seller shall not be liable for non-delivery of an order to the Buyer due to technical reasons not caused by the Seller.
These Terms and Conditions of sale and all the purchase agreements entered into on the basis of them are governed by the valid laws in the Slovak Republic as well as the international agreements on the protection of authors' rights. The Seller and the Buyer agree that they fully accept the electronic communication, in particular via electronic mail and the Internet, as valid and binding for both Parties. By submitting an electronic order, the Buyer accepts without reservation all the provisions of these Terms and Conditions of Sale as valid at the moment of submitting the order in the electronic form.
EFFECTIVENESS
These Terms and Conditions of Sale and any amendments thereto shall come into force and effect on 01 February 2023.
